This Site is hosted in the United States of America and operated in the United States of America, Canada and Mexico, and is only intended for users who are located in the in the aforementioned countries. The Extreme Collection makes no representation that the Site or any materials or Content (defined below) available thereon, are appropriate or available for use in locations other than the United States of America, Canada and Mexico. Those who choose to access this Site from locations outside of the aforementioned jurisdictions do so at their own risk and are responsible for compliance with applicable foreign laws.

Title to all goods sold on this Site passes to the buyer at the time of purchase in the state of California. If you require that your purchased items be shipped, you authorize us to engage a common carrier to deliver the goods on your behalf.  IF YOU CHOOSE TO SHIP YOUR GOODS OUTSIDE OF CALIFORNIA, YOU ASSUME ALL RESPONSIBILITY FOR COMPLYING WITH APPLICABLE STATE AND LOCAL LAWS REGARDING THE GOODS PURCHASED.

Products displayed on the Site are available while supplies last. In some cases, merchandise displayed for sale on the Site may not be available in The Extreme Collection stores. In-store pricing may sometimes differ from online prices and prices may change without notice. The prices displayed on the Site are quoted in U.S., Canada and Mexico. Dollars and are valid and effective only in the United States. Sales taxes will be added to the total price when required by law.

12. TERMS OF SALE; RETURN AND SHIPPING POLICIES

All purchases through our Site are governed by our returns and refunds policies, shipping policies, and terms and conditions of sale set forth herein as the same may be amended from time to time.

13. TERMS OF PAYMENT

Payment must be made by using one of the following credit cards, Klarna or an active PayPal account.

– Master Card;

– American Express;

– Discover Card.

The total amount of the order is charged to your credit card or PayPal account at the time the order is shipped. To pay by credit card or PayPal you must enter the account holder details, credit card number and security code information required at the check out portion of the Site. For payment using a PayPal account, you must enter your username and password in the specific fields on the PayPal page you are automatically directed to, then follow the procedures indicated on the page. The order procedure shall be considered effectively concluded on completion of the payment transaction. You will be automatically redirected to the page of the Site displaying the confirmation of acceptance of the order.

In the event that it is impossible to carry out the charge as a result of your making a mistake in entering the data or due to other technical causes, you shall not be able to complete the “order confirmation” procedure. If you decide to leave the payment page you will be redirected to a page of the Site which displays a message stating that it is impossible to confirm the order.

14. DELIVERY

Products shall be delivered to the address in the United States you have provided in your order after the completion of the order and payment process. You cannot request the delivery of products to a post office box and/or similar addresses.

In the event that the Product(s) is/are not delivered to you within four (4) business days following the date of shipment and it has proven impossible to track the location of the goods using the on-line system that will be made available to you, you must notify us of the non-delivery of the Product(s) using the “Contact us” page in the Customer Care section of the Web Site. In such case, we provide a new shipment of the lost Product(s) following your notification, unless the Products are no longer available or we cannot make delivery due to a force majeure event, in which case, the order will be cancelled and the amount paid will be refunded.

15. SHIPPING 

UPS is our Courier for all shipments. You will receive an email containing your tracking number once your package has been shipped.

On Sale or promotional campaigns could not include free shipping.

16. RETURNS

Thank you for your patronage. We hope you are happy with your purchase. However, if you are not completely satisfied with your purchase for any reason, you may return it to us for a full refund, store credit, or an exchange. Please see below for more information on our return policy.

All returns must be postmarked within ten (10) days of receiving the item. All returned items must be in new and unused condition, with all original tags and labels attached. Return labels are included with each package. Please see the descriptions outlined below which describe the procedure for each type of return.

16.1 RETURN PROCESS

To return an item, place the item securely in its original packaging and mail your return to the following address with the original invoice:

16.2 REFUNDS

After receiving your return and inspecting the condition of your item, we will process your refund. Please allow at least 5 to 7 business days from our receipt of your item to process your refund. If the item received by us is damaged, a refund will not be applicable.

16.3 REFUND OF DAMAGE GOODS.

Return the item within 48 hours after receiving the garment. Please allow at least 10 to 16 business days from our receipt of your item to receive the new one.

16.4 EXCHANGES

If an item does not fit, it can be exchanged for the same item of a different size or color.

Exchanges for a different brand product will not be refunded but rather be turned into store credit.

For exchanges, please call our Customer Service number at 714-326-2946. Please allow 10-16 business days for the exchange to be processed.

16.5 EXCEPTIONS

For defective or damaged products, please contact us at Customer Service at 714-326-2946 to arrange a refund or exchange.

All items on sale are final sales and are not refundable nor exchangeable.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF THE EXTREME COLLECTION  AND ITS ASSOCIATED PERSONS TO YOU FOR ANY DIRECT DAMAGES UNDER ANY LEGAL OR EQUITABLE THEORY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS AND CONDITIONS, YOUR USE, OR INABILITY TO USE, THE SITE OR ANY SERVICES AVAILABLE BY USING THE SITE SHALL NOT EXCEED THE TOTAL AMOUNT PAID TO THE COMPANY BY YOU FOR THE APPLICABLE PRODUCT OR SERVICE PURCHASED THROUGH THE SITE IN THE LAST SIX MONTHS OUT OF WHICH LIABILITY AROSE.

20. CHOICE OF LAW; JURISDICTION

These Terms and Conditions shall be governed by and construed in accordance with the internal laws of the State of California, without regard to its principles of conflict of laws. The exclusive jurisdiction for any Proceeding arising out of or related to these Terms and Conditions shall be in the State or Federal courts located within Orange County in the State of California. You hereby irrevocably consent to the personal and exclusive jurisdiction of such courts and waive any objections you may have on the basis of forum non-conveniens, venue, jurisdiction or otherwise. To the fullest extent permitted by applicable law, no Proceeding with respect to these Terms and Conditions, the Site, or products or services purchased through the Site shall be joined to a Proceeding involving any other party, whether through class action proceedings or otherwise.
